Sustained by reason of the nonPerformance of the premises and undertakings in said declaration mentioned at the sum of Three hundred and three Dollars and Twenty Cents: It is therefore considered by the Court that said Plaintiff recover of said defendants his damages aforesaid in form aforesaid by the Jurors assessed together with his costs and charges in this behalf expended and have thereof execution.

Coleman: Thomas Sappington: Green Park and Enoch Pina twelve good and lawful men who being duly elected tried and sworn the issue within joined between the parties aforesaid will and truly to try upon their oaths aforesaid say that as to the issue joined between the parties aforesaid upon their oaths do find that the said Plaintiff before and at the time of committing the said several grievances in the dec- laration mentioned was not now is she now a slave in manner and form as the said defendant hath in his said Plea alledged and they assess the damages of the said Plaintiff by her sustained by reason of the said several grievanc- ces in the declaration mentioned to the sum of one dollar. It is therefore considered by the Court that said plaintiff be liberated and entirely set free from the said defendant and from all persons claiming by through or under him by title derived since the commencement of this suit, and that said plaintiff recover of said defendant her damages aforesaid in form aforesaid by the Jurors assessed together with her costs and charges in this behalf expended and have thereof execution.

**William Glasgow vs John M Known Garnishee of Daniel Tolman**
Now at this day comes the plaintiff by his attorney and in his motion It is ordered that the Garnishee herein be discharged at this costs. It is therefore considered by the court that said Garnishee recover of said plaintiff his Costs and Charges in this behalf expended and have thereof execution

Assumpsit Now at this day comes the plaintiff by his attorney andfiles his declaration herein and the defendant by John F. Darly their attorney who produces to the court a power of Attorney to that effect duly Proven, also comes and says that they did undertake and Promise in manner and form as said plaintiff has in his declaration alledged against therein and acknowledged that said plaintiff has sustained damage by reason of the nonperformance of the Promises and un- dertakings in said declaration mentioned at the sum of Two hundred and five Dollars and fifty cents for which sum they confess Judgment. It is there- fore considered by the court that said plaintiff recover of said defendants his damages aforesaid in form aforesaid confessed together with their costs and charges in this behalf expended and have thereof execution.

Petition on note Now at this day comes the plaintiff by his attorney and fils his Petition herein and the defendant in his own Proper Reason comes and acknowledges himself indebted to said Plaintiff in the sum of Three hundred Dollars for which sums he con- fessess Judgment. It is therefore considered by the Court that said plaintiff recover of said defendant the debt aforesaid in form aforesaid confessed together with his casts and charges in this behalf expended and have thereof execution. By consent this Judgment to [ ?] in[ ?] at the rate of ten per cent per a[ ?] and execution on the same is stayed for two years.

And now at this day come again the parties by their respective Attor- neys, and by agreement of said par- ties, and with leave of the Court, all the pleas, demurrers and replications heretofore filed are withdrawn, and the Defen- dants file the following plea,_"And the said Defendants come and defend the wrong and injury when &c and say that the said Plaintiffs did not observe per- form fulfil and keep the promises, covenants, agreements and conditions, in the said Policies of Insurance contained, on their part and behalf to be observed ful- filled and kept; nor did the said Defendants neglect or refuse to observe fulfil and keep any of the covenants, promises, agreements, or conditions, in the said pol- icies of insurance contained, on their part to be observed, performed, fulfilled and kept, according to the tenor and effect, true intent and meaning of the said Poli- cies of Insurance, in manner and form as the Plaintiffs have above thereof alleged, and of this the Defendants put themselves upon the Country &c."_ Geyer for Defts._" Which said plea is filed with the following agreement of the parties, here made in open Court, to wit._"that the pleadings so amended shall stand and have the same ef- fect, as if the policies of insurance, in the declaration mentioned, had not been seal- ed with the seal of the Defendants, and the declaration and form of action were trespass on the case upon promises, and the plea, the general issue, Each party hav- ing the same right to introduce testimony, with the same effect, and all questions of Law aris- ing to be determined, as if this action was Assumpsit, and the plea, the general issue. The Defendants waiving proof of interest, notice of loss and claim of indem- nity, before the commencement of this suit, and admitting also the sea-worthiness of the Boat, excepting in the competency in number and skill of Engineers, the soundness and sufficiency of the Boilers, Engine and Machinery of said Boat._ The Plaintiffs on their part admitting that the losses and damages in the dec- laration mentioned, were occasioned by the bursting of one of the Boilers and brea- king of the Engine of said Boat, without external violence."
