To the honorable judges of the court of common pleas in
[illegible] of for the county of St. Louis in the missouri territory
The petition of William Clark of the town of
St. Louis in the county aforesaid
respectfully [illegible]
That a certain [illegible] Jaduthan Kendall in the aforesaid county being [illegible] to
your petitioner in the sum of one hundred and
thirty eight dollars fifty seven cents, for the [illegible] purpose
of more effectually securing the payment there of on the
fifth day of november eighteen hundred & eleven signed
sealed & delivered to him the said William , the plaintiffs
a certain [illegible] or indenture for a certain [illegible] or parcel
of land said to contain eight hundred [illegible] or french
acres of [illegible] buying [illegible] in the county of St. Louis
aforesaid on the grand [illegible] south of the river
[illegible] Merimack, which said [illegible] half a parcel of land was
confirmed to the said [illegible] the twenty
eighth day of march eighteen hundred & ten by
the board of land [illegible] Commisioners in & for the said
territory of Missouri as will appear [illegible]
had to [illegible] their minutes of proceedings Book number four
page three hundred & eight. It was also [illegible] stipulated
and agreed in said deed or indenture that of the said
[illegible] the defendant should [illegible] truly pay [illegible]
to be paid the aforesaid sum of one hundred thirty
\- eight dollars fifty seven cents on or before the twenteith
day of December then next [illegible] ensuing the date thereof [illegible]
as aforesaid mentioned then the said deed to be [illegible] void
otherwise it was to be [illegible] & remain in full force - all of
which will more fully & [illegible] & at large appear [illegible] had to the aforesaid deed or indenture which
the said Williams brings here with him into court
[illegible] that it may be considered as part [illegible]
of this his petition - Your Petitioner [illegible] begs leave
further to show your honors that no part of the aforesaid
sum of money has yet been paid for [illegible] securing of which
the said mortgage was given - He therefore prays

Prays the aforesaid Indenture or Deed of Mortgage
may be fore closed and that your [illegible] honors would
be pleased to enter up a [illegible] Deed to that effect of
order the tract a parcel of land as the same is
[illegible] bounded and described in said deed of Mortgage
to be sold for the payment of your petitioner
debt with interest of costs - & that your honor
would generally grant to your petitioner such
either of further relief as his case may [illegible]
& your petitioner as [illegible] will ever
pray [illegible]

We command you to summons [illegible] Jaduthan Kendall that [illegible] and
appear before the judges of our court of Common Pleas on the first monday of march next at a court to the
[illegible] at the town of S Louis . Then there to [illegible] if any he has why certain mortgage [illegible]
should not be sold according to Law, as [illegible] is within [illegible] for by William Clark , and have
you then there this [illegible] return [illegible] shall execute the same
