Court of Common [illegible] Pleas
[illegible]
William Clark by William [illegible] C. Carr his attor-
ney complains of Samuel Hammond in a plea of [illegible] on the case for that whereas the said Samuel Ham-
mond the defend and at the county aforesaid and
when the jurisdiction of this court on the seventh day
of november eighteen hundred & eleven [illegible] drew the follow-
ing draft or order on him in writing [illegible].
“Dr [illegible] Liz well you have the goodness to [illegible] deliver to James
“F. [illegible] require thirteen hundred dollars which you
“[illegible] were kind enough to offer by your note of yesterday
“upon [illegible] loan. "Yours respectfully""S. Hammond-"
“[illegible] William Clarke " "7th nov. 1811.”
which said draft was then & there presented to the said
William Clark the plaintiffs and the amount thereof
then [illegible] paid to the said James [illegible]. [illegible] F. who
[illegible] the [illegible] words &
figures following [illegible] “ Received thirteen hundred dollars
[illegible] “ from general [illegible] M. Clark agreeably to the [illegible] of the
[illegible] “above draft for [illegible] Col.. J. Hammond, James [illegible] F. [illegible] Hall,
“ nov. 7th 1811” By reason whereof the aforesaid samuel
Hammond the defendant became [illegible] liable to pay [illegible]
the said plaintiff the aforesaid sum of thirteen hundred
dollars whenever the same should be demanded
& buy so [illegible] promised to pay the same [illegible] thereof on demand - and for that whereas also
the said defendant on the same day [illegible] aforesaid
at the place [illegible] “ within the jurisdiction aforesaid the
said defendant [illegible] was indebted [illegible] the plaintiffs
in the further sum of thirteen hundred dollars
for so much money before that time by him to the
said defendant but and advanced at his special“
instance request & also for the sum of thirteen hun-
dred dollars for so much money by [illegible] him the said
defendant before that time had [illegible] to and

for the use & benefit of him the said plaintiff and [illegible] being
so undebted [illegible] in consideration thereof then & there [illegible]
faithfully promised to pay the said plaintiff The
aforesaid [illegible] several sums of money on demand-
[illegible] Nevertheless the said Samuel Hammond the
defendant [illegible] often requested [illegible] not paid the
aforesaid several sum of money not any part thereof
but the same to pay [illegible] with refused
to the plaintiff damage fifteen hundred dollars
wherefore he [illegible]

The United States of America to the Sheriff
of St Louis County Greeting.
You are commanded to summons Samuel [illegible] Hammond
that he be and appear before the Judges of our Court of Common
pleas at a court to be holden at St. Louis on the first Monday
of march next then to answer into William Clark in a plea of
[illegible] mishap on the case
To the damage of the said William Clark
the sum of fifteen hundred dollars
and have you then there this writ

this seventh of January one thousand
eight hundred and thirteen and thirty
