In the court of Common Pleas of the District of
St Louis of the term of July in the year of our Lord
one thousand eight hundred and nine St Louis
District ss.
Rezin Webster plaintiff complains of George Druillard
defendant of a plea of trespass on the case for that
whereas the said defendant and the first day
of June, in the year of our Lord one thousand
eight hundred and nine at the town of St. Louis
in the District of St. Louis and within the jurisdiction
of this court, made his certain promissory note in
writing, hearing date the day and year aforesaid, and
there then delivered the said Note to said plaintiff
and thereby in the words and figures following
to Wit: "St Louis June 1st 1809."
-“due R. Webster on demand eighty five
-dollars 62½ cents on settlement”
“[Cert?]" "George Druillard
"Denison[?] [?ing] [illegible] the said Geo
-[illegible] dollars and sixty two and a half cents, on demand and
by reason whereof and by force of the statute in such
case made and provided he the said defendant became
liable to pay to the said plaintiff the said sum mentioned in
the said Note according to the tenor and effect of said Note
and being so liable he the said defendant in consideration
thereof afterwards to wit - on the same day in the year at the
places and within the jurisdiction aforesaid undertook and
there then faithfully promised the said plaintiff to pay him the
said sum of money mentioned in the said Note according to ^ the said defendant ^
the tenor and effect of the said note and whereas afterwards
to wit - on the same day and year at the places and within
the jurisdiction last aforesaid was indebted to the said plain-
tiff in the sum of one hundred dollars for money by
the said plaintiff before that time said laid out and ex-
pended for the said defendant at his special instance
and request and for other money before that time had and
received by the said defendant to the use of said plaintiff
and for other money by the said plaintiff before then lent and

advanced to the said defendant at his like instance and
request and being so indebted to the Defendant in consideration
thereof aforesaid to Writ - and the same day and year at the
places and within the jurisdiction last aforesaid under
took and there then faithfully promised the said plaintiff
to pay him said sum of money last mentioned when he
should be there to afterwards requested yet the said defendant
[altho?] after requested has not paid the several sums of
money or any part thereof to the said plaintiff but to pay
the same or any part thereof to the said plaintiff has he then
wholly refused and still refuse to the said plaintiff
his damage of One hundred and twenty five
dollars.
and therefore he bring his his Suit &c.

Sheriff of the district of St Louis
Greeting.
We command you to take George Druillard if
he may be found within your bailiwick and [illegible] safely
keep so that you may have his body before the Judge
of our court of common pleas to be holden at the
town of St Louis on the first Monday of July and
then there to answer unto Rezin Webster of a plea
of trespass on the case to the damage of the said
Rezin Webster the sum of one hundred & twenty
five dollars and have you then there this
writ

[margin] Take bail for \$125

Witness the Hono. Silas Bent presid-
ing judge of our said Court at the town
of St Louis aforesaid this fifth day
of June in the year of our Lord one
thousand eight hundred & nine
of the independence of the United
