In Supreme Court of Missouri
of the March Term A.D. 1850

Irene Emerson, appellant
vs.
Dred Scott, a man of color, appellee

Points relied on by the Appellant

1st It is contended that Dr. Emerson, (the owner of the slave
Dred), a surgeon in the United States Army, did not
voluntarily & of his own free will, remove the said Dred
to Fort Snelling & Rock Island, but that from the
nature of his Office, he was subject to the order & direction
of the Government, whose servant he was.

2nd That the military posts of "Rock Island" & "Fort
Snelling," are under the military jurisdiction of the United
States, which, superseding the civil jurisdiction, abrogates
to a certain extent the Missouri Compromise act & the
Ordinance of 1787.
