THE STATE OF MISSOURI,

To John F. Darby

GREETING:

You are hereby commanded, that setting aside all manner of excuse and delay, you appear be-

fore our Circuit Court for the county aforesaid, on the 18th day of

December 1849 at the City of St. Louis, then and there to

testify, and the truth to say in ~~a~~ ^ two ^
certain matter ^ s ^ of controversy now pending in our said Court,

wherein Dred Scott is Plff in one and Harriet of color in other

plaintiff and
Irene Emerson

defendant ^ in both ^ on the part of Plff

and herein you are in no wise to fail.
